Mystery Box Terms and Conditions
This is a product with a chance to win prizes. Consumers' purchase or participation in the event does not mean that they will obtain specific products.

Terms and Conditions. These Mystery Box Terms and Conditions (“Terms”) apply to the MetalCore Mystery Box (“Mystery Box”) offered by MetalCore United Ltd. (“MetalCore”).

Eligibility. Mystery Boxes are available to users who are 18 years or older and not residents of a Prohibited Country. By accessing and using the Mystery Boxes, the user represents and warrants that they are 18 years of age or older. MetalCore reserves the right to verify the age of any user and to disqualify any user who does not meet the age requirement from receiving a Mystery Box and any rewards. You are not eligible for the Mystery Box if you do not agree to these Terms. By submitting your entry, you agree to comply with the Terms, MetalCore’s decisions about your eligibility for the Mystery Box, and determination of the winners of any rewards. In addition, you agree to accept any and all decisions of MetalCore, including as to eligibility and reward distribution, as final and binding. Further, you agree to follow and abide by any instructions issued by MetalCore in connection with the Mystery Box. You agree that our use of any personal information you provide will be subject to the terms of Metal Box’s Privacy Policy, available at [LINK]. The Giveaway is subject to all U.S. federal, state, local laws and regulations, and MetalCore reserves the right to cancel or suspend the Mystery Box at any time.

Prohibited Countries. Mystery Boxes are not available to users that are residents in the following countries (“Prohibited Countries”):
Austria
Belgium
Cuba
Iran
Netherlands
North Korea
Russia
Syria
Ukraine regions – Crimea, Donetsk and Luhansk Venezuela

Reviews. MetalCore reserves the right to withhold any rewards if it has a legitimate suspicion that the user has cheated the system or otherwise engaged in fraudulent or deceptive behavior. If MetalCore decides to withhold a reward, it will provide the user with a written explanation of the reason for the decision. The user may appeal the decision by contacting MetalCore in writing within 30 days of the decision. MetalCore will review the appeal and provide the user with a written response within 30 days of receiving the appeal.

No Gambling. Mystery Boxes are not a form of gambling and are provided for entertainment purposes only. Rewards may include unique digital assets intended for in-game use by participants, and are not intended to have any inherent dollar value. MetalCore will not be liable for any legal consequences that may arise from the use of Mystery Boxes or any Mystery Box rewards. By accessing and using the Mystery Boxes, the user agrees to indemnify and hold MetalCore harmless from any claims, losses, damages, or expenses that may result from their use or the use of any Mystery Box rewards.

Odds. Mystery Box rewards are randomly picked for each user, and it is not possible to open a Mystery Box more than once. The reward win rates are as follows:

Users will also be told the probability of obtaining each category of possible items (e.g. 80% for a “common” item, 15% for a “rare” item, and 5% for an “epic” item). We will not use a user’s personal or gameplay information to negatively impact the odds or results of receiving a valuable Mystery Box item. The odds of winning individual items will increase with every Mystery Box that is opened.

Limits. Users may be subject to daily limits on the number of Mystery Boxes that they may purchase or open.

Waiver of Liability and Release: By participating in the Giveaway and submitting an entry, you, waive, discharge, and fully release MetalCore, its respective affiliates, subsidiaries, and marketing and advertising agencies (each an “Indemnified Party”) from any and all liability, injury, damage, or loss that may occur, directly or indirectly, in whole or in part, from or in connection with participation in the Mystery Box, from the receipt or use of any Mystery Box or reward, or from any activity related to the receipt or use of any Mystery Box or reward. You agree to release and hold harmless the Indemnified Parties from and against any claim or cause of action arising out of, resulting from, or related to personal injury, death, or damage to, or loss of property, or any other claim or cause of action arising out of participation in the Mystery Box or receipt or use or misuse of any reward.

Taxes. Any federal, state, local, or other taxes on any reward are the sole responsibility of the user. All reward winners are solely responsible for paying and reporting, as and when required by law, all income taxes and other taxes and expenses attributable to any reward, whether or not MetalCore makes any withholding for taxes from the amount, and each winner authorizes shall indemnify, defend, protect and hold harmless MetalCore against all claims relating to such taxes and expenses.

Limitation of Liability. The Indemnified Parties are not responsible for late, incomplete, inaccurate, delayed, or incomplete entries or undelivered email; for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections; availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, or lines; or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind whether human, mechanical, electronic, network, computer, typographical, printing; errors or difficulties which may occur in connection with the administration of the Mystery Box, or in any Mystery Box-related materials, or otherwise relating to or in connection with the Mystery Box. The Indemnified Parties are also not responsible for any incorrect or inaccurate information, whether caused by users, tampering, hacking, or by any equipment or programming associated with or utilized in the Mystery Box. Indemnified Parties are not responsible for injury or damage to your or any other person's computer, wireless phone or landline phone related to or resulting from participating in this Mystery Box.

Dispute Resolution:  By purchasing a Mystery Box, you agree that (a) any and all disputes, claims, and causes of action arising out of or connected with the Mystery Box, or the reward, will be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with purchasing the Mystery Box, and in no event will entrant be entitled to receive attorneys' fees or other legal costs; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, special, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, or the rights and obligations of you and MetalCore in connection with the Mystery Box, will be governed by, and construed in accordance with the laws of the British Virgin Islands without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the British Virgin Islands. Any legal proceedings arising out of this Mystery Box or relating to these Terms will be instituted only in the federal or state courts located in the British Virgin Islands, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Terms. The invalidity or unenforceability of any provision of these Terms will not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms will otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. MetalCore’s failure to enforce any term of these Terms will not constitute a waiver of related rights.

Winner Verification. POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY METALCORE. METALCORE’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE ADMINISTRATION, OPERATION, AND CONFIRMATION OF THE WINNERS AND OTHER MATTERS RELATED TO THE MYSTERY BOX.
